I agree with you. Actually, the problem is almost the same with Tizen. They have a strange definition of the Open Web. It is rather the Open Web© (Mozilla Foundation™).

Even though Oracle just failed to make their case about (c) an API
the word is not yet our whether 'we' can install OpenJDK (or similar) on

Until now .. it seems that only Android's Dalvik VM got their pass,
so maybe the discussion should be more about _which_ Java like platform
can we install on today's mobile machines.
They seem to refuse the install of plugins and/or extensions whereas it could be an option to allow the use of Java without forcing the Mozilla Foundation to take any legal risk.
Anyway, Firefox OS will probably be a failure as it pretends to simplify the life of developers whereas the ecosystem around HTML5/Javascript/CSS is not mature enough to replace current mature application platforms.
Edit.: If Replicant supported more smartphones, it would be really interesting.
